Abstract (English):
The article raises the issue of legal regulation of criminal liability for evasion from serving of this type of punishment as restriction of freedom. There three-pronged approach, which was formed today in the practice of courts in deciding on the application of the means to individuals who maliciously evading the execution of this kind of punishment. It is pointed out the illegal decision of the same situations in different ways, which constitutes a violation of the idea of fairness in the administration of justice. On this basis, we offer our own vision of solving the problem that is appropriate to confirm the findings emerging from the study.
