Introduction: The article examines the criminal and administrative legal norms governing liability for the illegal trafficking of potent substances through pharmacy chains. The relevance of the work is due to the lack of legally established criteria for distinguishing related groups (Article 234 of the Criminal Code and Part 1.1 of Article 14.4.2 of the Administrative Code), which leads to contradictory law enforcement practices and decriminalization of organized criminal groups. The purpose of the work is to identify and analyze criteria that allow a law enforcement officer to distinguish between administrative and criminal liability for the illegal sale of potent substances in pharmacy organizations. Materials and methods: The research materials were scientific articles by scientists, the norms of the legislation of the Russian Federation, criminal cases, as well as judicial acts. The study applied a comparative legal analysis of norms, the study of judicial practice (including appellate and cassation rulings) and the synthesis of empirical data. The results of the study: made it possible to develop, summarize, systematize and analyze objective signs - criteria that make it possible to distinguish intentional criminal sales from reckless administrative offenses (consistency, conspiracy, violation of accounting rules, etc.). Findings and Conclusions: The findings of the study are of practical importance for law enforcement officers (investigators, prosecutors, courts) and can be used to improve criminal and administrative legislation, as well as methods for investigating crimes in the field of the illegal sale of potent substances.
