TRANSFORMATION OF THE COMPETENCE OF LOCAL SELF-GOVERNMENT BODIES IN THE FIELD OF PUBLIC ORDER MAINTENANCE

Abstract:
Introduction. The article analyzes problematic legal situations that arise as a result of significant changes in the competence of public authorities during the redistribution of powers between public authorities and local governments, using the example of the possibilities of the latter's participation in the protection of public order. Such changes do not always comprehensively cover all multilaterally interrelated provisions of laws, and sometimes they are introduced asynchronously. Thus, the fundamental norm establishing general principles may become invalid, but the concretizing and detailing norm stipulated by it in another law will continue to be implemented. Such incidents manifest themselves in the context of the spread of framework legal regulation at the horizontal level of the structure of Russian legislation. As a result of such legislative defects, a legal phenomenon arises, which is proposed to be considered as indirect ultraactivity, since the provision of the law that has become invalid continues to be implemented to some extent through the current provision that develops it. Materials and methods. The normative basis of the study was the legislation of the Russian Federation and the USSR, which continues to operate in the Russian Federation, subordinate regulatory legal acts concerning the competence of local governments in the field of public order protection and materials on the practice of exercising certain state powers that have not been transferred in accordance with the established procedure. The methodological basis of the study is a comparative-legal retrospective analysis, which makes it possible to understand the meaning of the provisions of the law in the framework of legal regulation and determine the potential for its implementation.. The results of the study. An analysis of the content of the provisions of the laws in force during the period of drafting, adoption and entry into force of a number of difficult-to-implement existing provisions of the laws allows us to conclude that the latter have adopted and are developing the repealed or significantly amended provisions. As a result, an imbalance is formed between the fundamental and concretizing norms, due to the weakening of the logical and substantive links between them. It is possible to replace the general rules, but to keep the specific ones unchanged. The difficulties that inevitably arise in the process of implementing such provisions are due to their insufficient correlation with the powers of the relevant public authorities. Problems in the implementation of the competence of local governments in the field of public order protection can often be conditionally resolved only in a "formal and legal" way, through the issuance of municipal legal acts that are potentially unable to have a significant impact on the emerging legal relations. Conclusions and conclusions. The reform of the system of public authorities, associated with the redistribution of powers between them, is a complex dynamic process, often asynchronously covering the entire complex of multilaterally interrelated normative legal acts. It is possible to transform the essence of the implementation of individual powers from direct implementation to participation in such. At the same time, the nature of some powers in the field of crime prevention is changing, from the own powers of local governments to individual state powers, which may be delegated, but not transferred in accordance with the established procedure.
