Abstract:
Introduction.The article explores current issues in the development of domestic theoretical jurisprudence. A key area requiring attention at both doctrinal and law-enforcement levels is improving the quality of scientific support for lawmaking. The author identifies priority scientific and methodological directions that contribute to enhancing lawmaking activities. The paper also highlights the socio-legal determinants of the lawmaking process, which establish the theory of lawmaking as an independent scientific theory within the general theory of state and law. Finally, the article outlines promising avenues for the development of lawmaking theory, including the improvement of lawmaking policy, the advancement and promotion of lawmaking culture, the optimization of lawmaking activities, and the evolution of legal and drafting techniques. Materials and Methods.In the course of the research, general and special scientific methods were used to reveal the scientific foundations for developing theoretical constructions. These include: the historical method, aimed at reproducing the evolutionary sequence of the object of knowledge; the logical method, which allows for establishing the essential properties of the studied objects and their causal relationships; the systemic-structural method, which helps identify patterns in the development of systemic relations based on systems theory; the method of legal thought experiment, which involves the mental construction of processes and states within a specific legal reality; the constructive-genetic method, aimed at identifying "progressive" and "regressive" outcomes of activity; the synergetic method, integrating systemology to determine the system-forming features of law-making; and the algorithmic method, which defines the procedure for building legal structures based on the cognition of legal reality, the processing of legal information, and the application of legal drafting techniques and language. The Results of the Study.The article examines the dual nature and specific research subject of the general theory of state and law. It highlights how the functions of this discipline are implemented within the broader system of legal knowledge. Taking into account both traditional and modern approaches, the paper reflects upon the methodology of theoretical legal research and outlines scientific perspectives on the concept of a scientific theory itself. Furthermore, the author explores the prerequisites for the emergence of specialized legal theories within the general theory of state and law, and establishes the socio-legal factors behind the formation of law-making theory. Finally, the study demonstrates the significance of law-making theory in the evolution of domestic jurisprudence and analyzes current trends shaping its further development in contemporary conditions. Findings and Conclusions.At the present stage of ongoing global transformation, the intensification of state legislative activity has acquired particular significance. Executing regulatory processes within these new political and legal realities requires the modification of national legal institutions. This transformation must rely on legislative structures and legal techniques adapted to contemporary conditions. Furthermore, improving the quality of legislative work demands a rigorous scientific substantiation of its methodological, organizational, and procedural principles. The theory of law-making, developed within the general theory of state and law, plays a crucial role in enhancing these scientific foundations. This theory implements specific legal functions—including regulatory, protective, compensatory, restorative, and restrictive ones—alongside broader social functions. The latter encompass methodological, political, ideological, formative, cultural-historical, informational, and educational dimensions, as well as social control, legal modeling, and legal forecasting. Together, these functions establish a comprehensive theoretical and legal framework for legislative activities and the law-making process. In contemporary conditions, emerging areas within the theory of law-making include law-making policy, legislative culture, regulatory processes, drafting activities, and legal drafting techniques.
