Abstract:
The article examines the spiritual and moral foundations of guarantees of the rights and legitimate interests of the individual as a component of the ideology of the Russian criminal process, since they represent a system of values and ideas enshrined in the Constitution of the Russian Federation and the current Code of Criminal Procedure of the Russian Federation, on which the national interests of the state are based. Different approaches in the general theory of law to the concept of guarantees are revealed. The essence of criminal procedural guarantees of the rights and legitimate interests of the individual is revealed from the point of view of spiritual and moral foundations. Materials and methods. The research materials were scientific articles, monographs of scientists, norms of the legislation of the Russian Federation. In the course of the research, the dialectical method was applied, the analysis of scientific and regulatory sources was carried out, and the comparative legal method was used. The research results made it possible to analyze the concepts of "guarantees" and "legitimate interest", to identify the main structural elements of the spiritual and moral foundations of guarantees of individual rights and legitimate interests: conscience, morality, traditions, mentality, conciliarity and the national spirit of the Russian people. Conclusions and conclusions. The analysis of the spiritual and moral foundations of guarantees of the rights and legitimate interests of the individual as a component of the ideology of the Russian criminal process made it possible to establish that the implementation of guarantees of the rights and legitimate interests of the individual depends on a combination of objective and subjective components of the activities of specific participants in criminal procedural relations, primarily officials conducting criminal proceedings.
