According to statistics, the number of victims of human trafficking increases every year, with trafficking in children and young women consistently occupying a leading position. According to numerous experts, the actual number of crimes committed on human trafficking differs significantly from the number of criminal cases initiated and brought to court. The current situation indicates, among other things, the problems of investigating the criminal cases under consideration. The article highlights the features of the criminal act of trafficking in minors, which significantly affect the developing investigative situations and, accordingly, the process of establishing and proving the objective side of the crime; identifies circumstances, the establishment of which can contribute to proving the fact of trafficking in minors; outlines the problems of applying the norm of the Criminal Code of the Russian Federation, providing for liability for trafficking in minors, affecting both the qualification of criminal acts and the process of proof.
