Введение: в статье рассматриваются вопросы определения системы преступлений, совершаемых в агропромышленном комплексе с учетом элементов экономических отношений, экономических интересов субъектов данной деятельности и совокупности признаков, на основе которых можно провести выделение родовых групп таких отношений. Межотраслевая структура агропромышленного комплекса порождает определенные отношения экономического характера: производство, переработка, реализация и др. Особенности отношений внутри каждой структуры формируют соответствующие предпосылки для совершения типичных видов преступлений, требующих классифицирования и выявления между ними закономерных связей. Материалы и методы: материалами исследования явились научные труды ученых в области уголовного права и криминалистики, публикации, отраженные в журнальных статьях по проблемам классификации преступлений, а также информационные данные, размещенные на электронных ресурсах. В рамках написания статьи применялись методы: научного обобщения, формально-логический, сравнительно-правовой и др. Результаты исследования: предлагается авторское определение преступлений рассматриваемой категории. Приведена криминалистическая классификация рассматриваемых преступлений на основе выделенных признаков агропромышленной деятельности. Внесено предложение об отнесении группы родовых объектов преступлений, совершаемых в сфере АПК, к межродовому объекту.
Introduction: the article discusses the issues of determining the system of crimes committed in the agro-industrial complex, taking into account elements of economic relations, economic interests of the subjects of this activity and a set of features on the basis of which it is possible to distinguish the clan groups of such relations. The interdisciplinary structure of the agro-industrial complex generates certain economic relations: production, processing, sale, and others. The characteristics of the relations within each structure form the appropriate prerequisites for the commission of typical types of crimes that require classification and identification of legitimate relations between them. Materials and research methods: research materials were scientists in the field of criminal law and criminalistics, publications, reflected in journal articles on the problems of classification of crimes, as well as informational data posted on electronic resources. As part of writing the article, the following methods were used: scientific generalization, formal logical, comparative legal, and others. Results of the research: the author's definition of crimes of the category under consideration is proposed. The forensic classification of the considered crimes on the basis of selected signs of agro-industrial activity is given. A proposal has been made to classify the group of generic objects of crimes committed in the sphere of the agro-industrial complex as an intergeneric object.
